Overdraft Privilege is available to all eligible checking accounts.
Overdraft Privilege is a discretionary courtesy that Kirkpatrick Bank is
extending to eligible Personal and Commercial Checking account holders.
Kirkpatrick Bank will pay, rather than return unpaid, customer Non-Sufficient
Funds items, up to assigned Overdraft Privilege limit. The standard per
item Non-Sufficient Funds charge applies as set forth in the Schedule of
Fees and Charges.
A $700 Overdraft Privilege limit will be assigned to all eligible Personal
and Commercial Checking accounts. A $500 Overdraft Privilege limit
will be assigned to all eligible Free Personal Checking accounts. New
accounts must be open at least 30 days. Existing customers must maintain
their account in good standing per the bank’s Overdraft Privilege Service
Description. Overdraft Privilege limit is included in your available balance.
You may access your Overdraft Privilege with your Kirkpatrick Bank
Check Card, Kirkpatrick Business Check Card, Kirkpatrick Bank
ATM Money Card, Internal Transfers, or by simply writing a check.
OVERDRAFT PRIVILEGE SERVICE
DESCRIPTION
(A Discretionary Overdraft Service)
It is the policy of Kirkpatrick Bank to comply with applicable laws and regulations,
and to conduct business in accordance with applicable safety and soundness standards.
We are not obligated to pay any item presented for payment if your account does not
contain sufficient funds. Rather than automatically returning, unpaid, any
non-sufficient funds items that you may have, if your eligible account has been open for
at least thirty (30) days and thereafter you maintain your account in good standing,
which includes at least: (A) Continuing to make deposits consistent with your past
practices, (B) You are not in default on any loan obligation to Kirkpatrick Bank,
(C) You bring your account to a positive balance (not overdrawn) at least once every
thirty (30) days, and (D) Your account is not the subject of any legal or administrative
order or levy, we will consider, as a discretionary courtesy or *service and not a right
or obligation, approving your reasonable overdrafts. This discretionary *service will
generally be limited to a $500 overdraft (negative) balance for eligible Free Personal
Checking Accounts, a $700 overdraft (negative) balance for other eligible Personal Checking
Accounts or a $700 overdraft (negative) balance for eligible Commercial Checking Accounts.
Of course, any and all bank fees and charges, including without limitation, our non-sufficient
funds fees (as set forth in our fee schedules) will be included in this limit.
If your account is not in good standing we have the right to revoke your Overdraft
Privileges. You will be notified by mail of any non-sufficient funds item paid or
returned that you may have; however, we have no obligation to notify you before we
pay or return any item. The amount of any overdrafts plus our Non-Sufficient Funds
(NSF) Charge(s) that you owe us shall be payable by you. If there is a non-sufficient
funds check paid by us on an account with more than one (1) owner on the signature
card, each owner, and agent if applicable, drawing/presenting the item creating the
non-sufficient funds situation, shall be jointly and severally liable for such
overdrafts created by the payment of non-sufficient funds check plus our Non-Sufficient
Funds (NSF) Charge(s).
LIMITATIONS: Available only to eligible personal and commercial checking accounts.
We may limit the number of accounts eligible for the Overdraft Privilege* service
to one account per household.
*The Overdraft Privilege service does not constitute an actual or implied agreement
between you and Kirkpatrick Bank. Nor does it constitute an actual or implied
obligation of or by Kirkpatrick Bank. This service represents a purely discretionary
courtesy or privilege that Kirkpatrick Bank may provide to you from time to time in
the event your account becomes unintentionally overdrawn and which may be withdrawn
or withheld by Kirkpatrick Bank at any time without prior notice or reason or cause.
